Abstract

In a personal law system, women should have greater power so that we can achieve gender parity. Personal laws specify the responsibilities and rights of family members. Religious and cultural views that are harmful to women are the foundation of many of these laws. Depending on how these traditions are practiced, women may be given more or less power. Cultural and religious norms provide the basis for these practices, which are in turn based on ideas of masculine authority. In a culturally varied country like India, this study looks at how personal laws impact women's freedoms, rights, and social standing. The study aims to reveal areas where women lack adequate legal protection by analyzing several religious legal systems, including Hindu, Islamic, Christian, and indigenous tribal laws. Literature reviews look at ways to alter people's mindsets in order to empower women and guarantee equality for all genders. This research looks at how personal laws have changed throughout the years in a number of different countries. It shows how big an effect changes in the law may have and how hard it is for women to get fair treatment in family and marriage contexts. This looks at the economic and social obstacles that women face and stresses the importance of progressive laws that give women rights in areas like marriage, property, divorce, and child custody. To safeguard women's autonomy, dignity, and opportunities in all areas of society, the article argues that revisions to personal law are required. At the end of the analysis, the authors suggest laws that would better protect women's rights under personal law regimes, both new laws and changes to existing ones. Social justice and the rule of law are to be enhanced by this.
